Human Resource Laws
Technology companies face distinctive workforce challenges. The line between employee and contractor is blurry. Compensation structures involve ESOPs that create complex tax and compliance implications. Teams are distributed. The Labour Codes are rewriting the rulebook.
We advise on the full spectrum of employment and labour law as it applies to technology businesses, with particular focus on the areas where technology and work intersect: remote work policies, ESOPs, contractor versus employee classification, and the transition to the new Labour Codes. Talent is a technology company's most valuable asset — employment structures must attract, retain, and protect while maintaining compliance.
What We Do
- Employment agreement drafting (offer letters, appointment letters, separation agreements)
- ESOP/ESPS design, implementation, and grant documentation
- Contractor versus employee classification analysis
- Prevention of Sexual Harassment (POSH) Act compliance
- Workplace policy drafting (remote work, BYOD, acceptable use, social media)
- Labour Code compliance assessment and transition planning
- Non-compete and restrictive covenant structuring
- Employee grievance and disciplinary procedure advisory
Regulatory Context
India's labour regulatory framework is undergoing a significant transformation with the Labour Codes 2020: the Code on Wages, Industrial Relations Code, Social Security Code, and Occupational Safety, Health and Working Conditions Code. These operate alongside state-specific Shops and Establishments Acts, the POSH Act 2013, the Payment of Bonus Act 1965, the Employees' Provident Funds Act 1952, and the Payment of Gratuity Act 1972. The transition to the new Codes is still in progress, with implementation timelines varying by state. We help technology companies navigate both the existing regime and the transition.
Who This Is For
Technology startups structuring initial employment frameworks. Scaling companies implementing ESOPs. Platform companies with gig workforce considerations. Companies with distributed and remote teams. Businesses navigating Labour Code transitions. If you employ people or engage contractors in India's technology sector, the compliance landscape is more complex than it appears: this practice covers it.
